HOW TO BUY A SPALT INSTRUMENT

 

We appreciate that you are interested in buying one of our unique instruments. There are three basic possibilities to purchase a guitar or bass made by Michael Spalt.

ORDERING DIRECTLY FROM SPALT INSTRUMENTS

 

No matter if you purchase an instrument already made or order a custom built made to your specifications we like to keep a close communication with our customers.

 

If you order an instrument that has already been made the sale can be processed via email. Some conditions apply, see the fine print below!

 

PLACING A CUSTOM ORDER

  1. The first step is for you to look over and complete a detailed order sheet. This will help you to think about details you might not have yet considered. We also encourage you to look through the gallery of instruments for ideas about what you like (and don't like).
  2. Once we receive this 'wishlist' from you we will go over it and quote you a price, which you will have to reconfirm to make sure nothing was left out or remains unclear.
  3. In order for us to start working on your instrument we need to receive a 50% deposit. Once we have started working this deposit is non-refundable (see 'Fine Print' below for more details).  
  4. Updates are given by email and any changes are confirmed by email as well, on request we will send you photos throughout the process.

For Totemguitar orders using materials supplied by the customer please contact us for information. Due to sometimes unpredictable reactions of the resin to materials there is always the possibility of discoloration, damage, or destruction of materials, and some materials are unsuited to be used.

 

For custom orders placed through dealers this process remains the same -- we want to keep direct communication with you to ensure your instrument will fulfill your specifications!

 

THE 'FINE PRINT' -- OUR TERMS AND CONDITIONS

 

PRICES

All our prices are listed with 20% VAT unless otherwise specified.

 

For orders from outside the EU the customer is responsible for all duties, custom charges and other applicable fees.

For customers from EU-countries: Unless you are a retailer or professional musician with a valid VAT ID number we have to charge the Austrian VAT of 20%. If you have a VAT ID number please provide it to us at the time of ordering.

For customers from outside the EU: If the instrument is shipped using an official carrier we do not have to charge the Austrian VAT, but you will be charged the applicable duties and custom fees by the carrier. If the instrument is picked up in person we have to charge VAT, but we will provide the paperwork required to have it refunded.

 

PAYMENTS

We accept cash or wire transfers. For wire transfers within the EU we will provide the IBAN you need to use. Items will be shipped only after full payment / all funds have been credited to our bank account.

 

To finalize a custom order and start building we require a 50% non-refundable material deposit. The remaining amount (plus shipping, etc. where applicable) is due before shipping.

 

CANCELLATIONS

 

For orders of already made instruments: once you receive the guitar you have a period of 14 business days to return the instrument should you not find it to your liking. In this (unlikely) case you have to notify us in writing (by email) and return the instrument at your own cost. Any payments made will be refunded after costs or damages incurred have been deducted (that includes shipping cost).

 

For custom orders: Due to the unique nature of our instruments, once we have started to build an instrument to your specifications it will be very difficult to resell it. Therefore, all custom orders are final and there is no refund.  Please keep that in mind before deciding to place the order.

 

WARRANTY

Products manufactured and sold by Spalt Instruments carry a limited warranty against defects in materials or workmanship for the first buyer for the time span of 2 years after purchase. This warranty is valid for 24 months from the day of purchase for the first buyer of the instrument. Damages caused by inappropriate handling, storage or during transport are exempt from the warranty. A detailed description of our warranty policy will be included with our instruments.

 

SHIPMENT, TAXES AND CUSTOMS

We will ship FedEx or UPS unless otherwise specified by the customer. Customer is responsible for all shipping charges, as well as applicable taxes, duties or custom fees. Upon pick up of the shipment by a transport company the customer assumes all risks of transportation. A transport insurance is usually included in our shipping rates.

 

OTHER

Gigbags and hardshell cases are available upon request. Hybrid models come with a gigbag and a custom stand.

 

Place of fulfillment is Vienna. The Austrian Law applies. Application of CISG is expressly excluded.

 

Declaration on data protection and your privacy:

The protection of your personal data is very important to us. Therefore we process your data exclusively on the basis of the legal regulations (DSGVO, TKG 2003).

 

Communication with us:

If you contact us via the form on the website or by e-mail, your data will be stored for six months to process the request and in case of follow-up questions. We will not share this information without your consent.

 

Your personal data when placing an order:

Orders are placed by email, usually with our order form (.pdf). For that purpose your name, email address and all other pertinent data for the order, billing, and shipping will be processed through our email servers and stored on our computer(s).

 

We do not give any data to third parties unless:

• we are required by law to do so (that includes also the acquisition of for example CITES documents if applicable)

• it is necessary for shipping and related customs processes

 

We retain all data until the expiration of the tax retention period (7 years) or longer if required (like CITES documents).

The data name, address, purchased goods and date of purchase are also stored until the end of product liability (10 years).

Your rights:

In principle, you have the rights to information, correction, deletion, restriction, data portability, revocation and opposition. If you believe that the processing of your data violates data protection law or if your data protection claims have otherwise been violated in a way, you can complain to the supervisory authority. In Austria, this is the data protection authority.
